For the purpose of this document, “K2 & Associates Limited” is also referred to as K2 & Associates Ltd, and includes “Mind Skills Mastery” and “NLPCoachingMastery” both divisions of K2 & Associates Limited, a New Zealand registered company

Information
We gather various information about customers and users of our website. This information includes:
- personal information through your voluntary use of the Website and the purchase process (such as your first and last names and email);
- personal information, provided to us by you through any other method (including without limitation correspondence and discussions);
- information collected by us through click tracking in relation to your use of the Website, including the content you upload and the content you access; and
- aggregated data, which tracks traffic to the Website; and cookies, which are pieces of information transferred to your computer hard drive for record keeping (such as your preferences on our Website).
Security
We are committed to ensuring that your information is secure. In order to prevent unauthorised access or disclosure we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online.
Use of your information
We will never sell or rent your personal information to third parties.
We will use information we collect from you for the primary purpose for which it is collected and for such other secondary purposes that are related to the primary purpose of collection. We generally use personal information to complete delivery of our documents to you, help us manage and enhance our services and to communicate with you.
Email Newsletters and other notices
It is our policy to send emails throughout the enquiry and purchasing process and other newsletter emails you elect to receive. In addition, we may send out promotional material to you promoting new or amended material on our site where we think that may be relevant to you. It is our policy to immediately remove any person from any mailing list upon the person’s request.
Credit Card /payment details
Payment for our service may be done via PayPal, which may ask you to provide further information (including credit or debit card details). This information is retained by PayPal and will not be passed on to us. We advise you to read the Terms and Conditions and Privacy Policy on the PayPal site for further information on what information will be required and the way PayPal will use it.
Cookies
Cookies are small pieces of information that are stored in a browser-related file on your computer’s hard drive when you use our Web site. Cookies are widely used on most major Web sites. Overall, cookies help us provide you with a better website, by enabling us to monitor which pages you find useful and which you do not. This helps us analyse data about web page traffic and improve our website in order to tailor it to customer needs. A cookie in no way gives us access to your computer or any information about you other than the data you choose to share with us.
We may use information contained in cookies to make assumptions about the user of the computer and to provide users of that computer with focused advertising that we believe may be of interest, based on that information.

Other information we collect
We collect and use additional information to carry out internal research on our users’ demographics, interests, and behaviour to better understand and serve you and our community. This information may include the URL that you just came from (whether this URL is on our site or not), which URL you next go to (whether this URL is on our site or not), what browser you are using, and your IP address.
If you post on our site, on twitter or Facebook or other social media site about us or your experience with us, we may collect that information for the purposes of improving our service and the end user experience.
Access and removal of Information
You have the right to seek access the personal information held about you and to advise us of any inaccuracy. If you make an access request, we will ask you to verify your identity and specify what information you require. We may charge a fee to cover the costs of meeting your request. There are some exceptions to this right set out in the New Zealand Privacy Act. You may unsubscribe from newsletter and information updates at any time, and we will ensure that your personal information is removed from our database and our newsletter service provider. We must retain personal information for all financial transactions enacted in the course of providing products and services under the New Zealand Financial Acts administered by the New Zealand Inland Revenue Department.

Our website may contain links to enable you to visit other websites of interest easily. However, once you have used these links to leave our site, you should note that we do not have any control over that other website. Therefore, we cannot be responsible for the protection and privacy of any information which you provide whilst visiting such sites and such sites are not governed by this privacy statement. You should exercise caution and look at the privacy statement applicable to the website in question.
Updates to our information practices
We reserve the right to change this policy. By continuing to use the Website, you agree to be bound by the amended policy. You should check from time to time to see if the policy has changed.
Training & Workshops Terms and Conditions
Applying for a course, booking an online training or coaching and consulting services is acknowledgement that you have accepted and agree to be bound by these terms and conditions.
Payment Terms: General
We require full payment to be made before the course is presented. We will consider waiving this condition once a good business relationship has been established, and might then also consider discounts for early payments of courses.
If the client fails to make payment on the due date, K2 & Associates Ltd reserves the right to charge interest at a rate of 6% above the bank rate until payment is received in full. (A part of one month is treated as one full month, for calculation purposes). Any training material and collateral remain the property of K2 & Associates Ltd until full payment has been received.
Where an account remains overdue K2 & Associates Ltd reserves the right to charge the client any debts that may be incurred in the recovery of the outstanding invoices. A 10% recovery fee may be applied in addition to debt collection fees.
Open Enrolment Training & Courses
Places are limited and can only be guaranteed on receipt of payment. You must pay in advance of all booked training sessions.

Special offers and payment plans: your first payment acknowledges your agreement and commitment to pay the term of the payment plan in full.
Your payment confirmation will be followed by an email confirming your place and your receipt will be sent to you along with details of directions and any preparation you will need to do for the course. You should receive this within 72 hours of receipt of your payment confirmation and no later than one week prior to the start of the course.
Once you have accessed the Training or Coaching portal, including Zoom, Facebook or other hosting sites, you acknowledge that you are in full receipt of the service you have purchased.
Cancellation Policy
Cancellation more than 15 days before the course start date, no cancellation fee will apply.
Cancellation within 14 days before the course start date, a 10% cancellation fee may apply
Cancellation within 10 days before the course start date, a 50% cancellation fee may apply.
Cancellation within 5 days of the course start date, no refund will be given.
No refund will be given to cancellations or non attendance during the course.
Cancellations due to medical emergencies will be accepted without applying any cancellation fee.
In House Training
Bookings must be fully paid for by the due date on the invoice, or no later than 15 days prior to the course start date, whichever is sooner. If course fees have not been received within the stated period the course may be cancelled. The company contact will always be notified prior to this occurring. Any agreed expense re-imbursements will be invoiced within 7 days of incurring the expense. Expenses are payable immediately on receipt of invoice.
Conditions
Our courses are planned months in advance but despite our best efforts and forward planning we may have to occasionally make changes to the scheduled dates.
Whilst every effort is made for all courses to go ahead as planned it very occasionally becomes necessary to re-schedule or even cancel courses. Alternatives will always be offered. Where appropriate a refund of course payment fees will be given.
Having a minimum level of candidates on a course is important as class participation is essential for an effective learning environment and we would always want our clients to have the very best experience throughout the course.
By attending any of the courses run by K2 & Associates Ltd all delegates undertake not to disturb, interrupt or otherwise impair the course for any other delegates. Where necessary K2 & Associates Ltd may at its own discretion and without discussion ask any delegate to leave the course. In such circumstances no refund of course fees will be given.
Coaching Services and Programs
Places or bookings are limited and can only be guaranteed on receipt of payment.

Confidentiality and Limit of Liability
Any information divulged to the Coach by the Client shall remain completely confidential, except in the event of the Coach’s knowledge of any illegal activity by the Client, or admission by the Client of the intent to commit an illegal act. The Client acknowledges the obligation of the Coach to cooperate fully with law enforcement and other authorities as required by law. The Client acknowledges that the Coach is not in the business of providing advice, medical, legal or otherwise, and the Client should retain the services of a qualified professional in any particular area where such qualified advice is required.
Furthermore, the Coach does not provide therapy or mental health counseling. Clients with psychological or other medical problems should consult a qualified health care professional. Any action taken in regard to therapy, medical advice, or mental health counseling, or any other activity not directly related to the Services provided to the Client by the Coach will be at the sole discretion of and will remain the sole responsibility of the Client, and the Coach will not be held accountable and shall remain blameless for any consequences arising as a result of any professional therapy, counseling or any other activity not directly related to the Services provided by the Coach.
Copyright
All intellectual property rights in material supplied by K2 & Associates Ltd is subject to copyright and owned by K2 & Associates Ltd and therefore any duplication in whole or in part is strictly prohibited. Any recordings or copies made of course materials will be an infringement of copyright unless agreed in advance and in writing by K2 & Associates Ltd.
Liability
All information provided by K2 & Associates Ltd is given in best faith and K2 & Associates Ltd will not be held responsible for actions taken by the client, any other individual or organisation as a result of the information provided during the training course or coaching service.
The courses and coaching services are carefully prepared and led by qualified Trainers and NLP Practitioners. K2 & Associates Ltd does not accept liability for the application or distribution of the matter covered in the courses or coaching services nor any damages arising as a consequence thereof.
K2 & Associates Ltd is only liable for physical and financial damages – irrespective of legal basis – as a result of willful intent or gross negligence on the part of employees of K2 & Associates Ltd.
Corporate Consulting & Coaching Services Terms and Conditions
All invoices for Consulting and Coaching Services must be paid by the 20th of the month. Bookings or contracts cancelled within 24 hours may be invoiced at 50% of the agreed rate.
Expenses
All expenses incurred in the delivery of Consulting & Coaching Services will be agreed in advanced, and are payable within seven (7) days of being incurred.
